The purpose of this Privacy Policy is to explain how FilmCafé Studio Kft. (hereinafter: FilmCafé Studio or Controller) processes personal data in compliance with the applicable data protection laws, in particular Regulation (EU) 2016/679 (GDPR).
2. Definitions
•Personal Data: any information relating to an identified or identifiable natural person (e.g. name, e‑mail address, phone number).
•Data Subject: the natural person whose Personal Data are processed by the Controller (e.g. clients, business partners, contact persons, subcontractors, website users).
•Processing: any operation performed on Personal Data (such as collection, recording, storage, use, transmission, erasure, etc.).
•Processor: a natural or legal person which processes Personal Data on behalf of the Controller (e.g. hosting provider, accountant, IT service provider).
3. Purposes and legal bases of processing
FilmCafé Studio processes Personal Data mainly for the following purposes:
3.1. Contact and estimate requests (website forms, e‑mail, phone)
•Data Subjects: natural persons who contact FilmCafé Studio via e‑mail, by phone, or through the contact / estimate request forms on https://filmcafe.hu.
•Data processed: name, e‑mail address, phone number, project‑related information, message content.
•Purpose: handling enquiries, providing estimates, preparing and maintaining business relationships, communication.
•Legal basis:
•the Data Subject’s consent (Article 6(1)(a) GDPR), which is given by sending the message / submitting the form; and/or
•the Controller’s legitimate interest in responding to enquiries and maintaining professional communication (Article 6(1)(f) GDPR).
•Retention period: up to 2 years from the last contact, unless a contract is concluded (in which case the retention period for contractual data applies).
3.2. Contractual partners, clients and subcontractors
•Data Subjects:
•natural person clients,
•contact persons of corporate clients,
•freelance film professionals working with FilmCafé Studio (e.g. director, cinematographer, animator),
•contact persons of other service providers (e.g. accountant, lawyer).
•Data processed: name, company name, position, correspondence and billing details, e‑mail address, phone number, bank account details, and information necessary for the relevant contract or project.
•Purposes:
•conclusion and performance of contracts,
•invoicing, accounting, fulfilment of legal obligations,
•communication and organisation of production‑related tasks.
•Legal basis:
•performance of a contract (Article 6(1)(b) GDPR),
•compliance with legal obligations (e.g. accounting and tax laws – Article 6(1)(c) GDPR),
•the Controller’s legitimate interest in maintaining communication and managing productions (Article 6(1)(f) GDPR).
•Retention period: generally 5 years from the end of the contractual relationship (statutory limitation period for civil law claims); accounting documents must be retained for 8 years according to applicable law.
3.3. Newsletter and marketing communications (if used)
(If you do not use newsletters, you can omit this section from the live version.)
•Data processed: name, e‑mail address.
•Purpose: sending information about film services, new projects, portfolio updates and professional news.
•Legal basis: the Data Subject’s explicit consent (Article 6(1)(a) GDPR).
•Retention period: until consent is withdrawn (unsubscribe).
3.4. Website logs and cookies
When you visit filmcafe.hu, the hosting provider may automatically record certain technical data (such as IP address, browser type, date and time of visit) in server logs in order to maintain the security and proper operation of the website.
These data are used by the Controller for system administration, troubleshooting and IT security purposes only, in accordance with the GDPR and applicable Hungarian laws.
If analytical or marketing cookies are used on the website, these will be explained in a separate cookie notice and, where required, will only be set with the user’s consent.
4. Processors
FilmCafé Studio may engage data processors for certain technical aspects of Processing, such as:
•web hosting and e‑mail service providers,
•web developer / system administrator,
•accounting firm,
•online form and e‑mail delivery services (e.g. WordPress, WPForms, SMTP service).
Processors may only process Personal Data on the basis of a written agreement with FilmCafé Studio and in accordance with the GDPR.
5. Data transfers
Personal Data may be transferred to third parties only in the following cases:
•to public authorities or courts if required by law or upon a lawful request,
•to accountants, legal representatives, IT service providers and other processors, where necessary for the purposes described above,
•in the context of specific film productions, to foreign co‑producers or commissioning partners where this is necessary for contract performance and appropriate GDPR‑compliant safeguards are in place.
Where Personal Data are transferred outside the European Economic Area, FilmCafé Studio will ensure that such transfer is based on an adequacy decision, standard contractual clauses or other appropriate safeguards as required by the GDPR.
FilmCafé Studio does not sell Personal Data and does not transfer them to third parties for their own marketing purposes.
6. Rights of Data Subjects
Data Subjects have the following rights in relation to the Processing of their Personal Data:
•Right of access: to obtain confirmation as to whether or not FilmCafé Studio processes Personal Data concerning them, and, where that is the case, to access those data and certain related information.
•Right to rectification: to request correction of inaccurate Personal Data and completion of incomplete data.
•Right to erasure (“right to be forgotten”): in certain cases, to request the deletion of their Personal Data.
•Right to restriction of processing: in certain cases, to request that the Processing of their Personal Data be restricted.
•Right to data portability: where Processing is based on consent or on a contract and carried out by automated means, to receive their Personal Data in a structured, commonly used and machine‑readable format and to transmit those data to another controller.
•Right to object: where Processing is based on legitimate interests, to object to the Processing of their Personal Data on grounds relating to their particular situation.
